These Terms of Service apply to your access to and use of fulltiltgarage.com.au and to purchases made from Full Tilt Garage.

By accessing our website or placing an order, you agree to these Terms, subject to any rights that cannot lawfully be excluded.
1. Online store
Our online store is hosted using Shopify and may use third-party providers for payment processing, production, fulfilment and shipping.
You must provide accurate and current information when placing an order.
You must not use our website or services for any unlawful or fraudulent purpose.
2. Products
We make reasonable efforts to accurately describe and display our products.
However, actual product colours and appearance may vary slightly because of screen settings, manufacturing processes, garment characteristics and reasonable production tolerances.
Minor differences in print positioning, colour reproduction or garment characteristics may occur with made-to-order merchandise.
Nothing in this section limits your rights under applicable consumer law.
3. Made-to-order merchandise
Many Full Tilt Garage products are manufactured specifically after a customer places an order.
Because these products are made to order, we generally do not offer returns, exchanges or refunds for change of mind, incorrect size selection, incorrect colour selection or buyer's remorse.
Please review product details and sizing information carefully before purchasing.

4. Orders
Placing an order constitutes an offer to purchase the selected products.
We may refuse or cancel an order where reasonably necessary, including where:
- payment cannot be authorised;
- a product is unavailable;
- incorrect pricing or product information has been published;
- fulfilment is not reasonably possible;
- fraud or unauthorised activity is suspected; or
- an order breaches these Terms.
If we cancel an order after payment has been received and no goods are supplied, we will refund the applicable amount.
5. Pricing
Prices are displayed in the currency shown on the website or during checkout.
Shipping charges and other applicable costs will be displayed where reasonably practicable before you complete your purchase.
Customers purchasing from outside Australia may also be responsible for customs duties, taxes or import charges imposed by their country.
6. Payment
Orders must be paid using an accepted payment method available through checkout.
Payment may be processed by Shopify Payments, PayPal or other payment providers made available through the website.
Use of those payment services may also be subject to the provider's terms and privacy policies.
7. Production and delivery
Made-to-order products require production before shipment.
Production and delivery dates are estimates and may be affected by circumstances outside our reasonable control.

8. Returns and refunds
Our Refund & Returns Policy explains when returns, replacements and refunds may be available.
Nothing in these Terms or any other Full Tilt Garage policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
9. Australian Consumer Law
Goods sold by Full Tilt Garage may be subject to statutory consumer guarantees under the Australian Consumer Law.
Where Australian Consumer Law applies, consumers may be entitled to a repair, replacement, refund, re-supply or compensation where products fail to comply with applicable consumer guarantees.
Our change-of-mind policy does not limit those statutory rights.
10. Intellectual property
Unless otherwise stated, the Full Tilt Garage name, logos, branding, graphics, photographs, videos, artwork, written material and other original content displayed through our website and associated channels are owned by or licensed to Full Tilt Garage.
You may not copy, reproduce, modify, distribute, sell, commercially exploit or create derivative works from that material without prior written permission, except where permitted by law.
Purchase of a Full Tilt Garage product does not transfer any intellectual-property rights in the branding, artwork or design appearing on that product.
11. Website use
You must not:
- use our website unlawfully or fraudulently;
- interfere with the operation or security of the website;
- attempt unauthorised access to accounts or systems;
- introduce viruses, malware or malicious code;
- scrape or automatically extract content without permission;
- infringe our intellectual-property rights or those of another party; or
- use the website in a manner that could damage Full Tilt Garage or other users.
12. Third-party services and links
Our website may contain links to, or integrate with, third-party websites and services.
We are not responsible for the content, availability or practices of independent third-party websites.
Use of third-party services may be governed by their own terms and privacy policies.

We make reasonable efforts to keep product descriptions, pricing and other website information accurate.
Occasionally, information may contain typographical errors, inaccuracies or omissions.
Where an obvious error affects an order, we may contact you to correct the issue or cancel the affected order and provide an appropriate refund.

Nothing in these Terms excludes or limits liability that cannot legally be excluded.
To the maximum extent permitted by law, Full Tilt Garage is not liable for indirect, incidental or consequential loss arising from use of the website or products where such liability may lawfully be excluded.
15. Events outside our control
We are not responsible for failure or delay caused by events outside our reasonable control, including natural disasters, severe weather, transport disruption, industrial action, network outages, government action or significant supply-chain disruption.
This provision does not affect rights that cannot lawfully be excluded.
16. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary, and the remaining provisions will continue to apply.
17. Governing law
These Terms are governed by the laws of Queensland, Australia and applicable Commonwealth laws.
Nothing in this provision limits any mandatory rights a consumer may have under applicable law.
18. Changes to these Terms
We may update these Terms from time to time.
The version published on our website at the time an order is placed will apply to that order, subject to applicable law.
